Spanish lawyers work by area of law: immigration (extranjería), administrative, tax, property, commercial, family, inheritance and criminal. The person who handles an appeal against a residence permit refusal is usually not the one who deals with an inheritance dispute. If you need an immigration lawyer, look for a specialist in extranjería.
Hence the first question to answer before you start looking: which specialisation you need and whether you need a lawyer at all. In Spain, “legal adviser” is not a profession but a colloquial term. It covers three different specialists with different powers: the abogado, the gestor administrativo and the asesor. The difference lies not in the sign on the door or the price, but in who is entitled to defend you in court, who is bound to keep your secrets and who can be checked in a public register.
Below we explain how these three differ under the law, how to check any of them in two minutes and what a lawyer does in each specialisation.
Three specialists people confuse
Abogado — lawyer. Under the General Statute of the Spanish Legal Profession (Real Decreto 135/2021, published in the BOE), only a practising member of a bar association (colegio de abogados) may call themselves an abogado (arts. 4.1–4.2). To practise you need a law degree and registration with the bar association where you mainly work (art. 7.1). A lawyer defends you in court, handles disputes with the authorities and appeals refusals.
Gestor administrativo — gestor. Also a regulated profession with its own professional association. A gestor is an intermediary between you and public bodies: they submit documents, handle administrative procedures and take care of the paperwork that needs doing. They do not represent you in court.
Asesor — consultant. The word is not protected by law. Anyone can call themselves a tax or employment law asesor, including someone with no legal training. Some of them are strong specialists, but there is nowhere to check their status: no register of asesores exists.
| Lawyer | Gestor | Asesor | |
|---|---|---|---|
| Title protected by law | yes | yes | no |
| Mandatory membership of a professional association | yes | yes | no |
| Public register exists | yes | yes | no |
| Defends you in court | yes | no | no |
| Legal duty of professional secrecy | yes | — | no |
The table does not mean a gestor is worse. For submitting documents for an NIE or renewing a residence permit where nothing is in dispute, a gestor is a sensible and usually cheaper choice. The question is what to do when something goes wrong.
Immigration lawyer, agency or gestor: who you need for a residence permit
To apply for a Spanish residence permit, the law requires neither a lawyer nor a gestor: you can file the application yourself or through any representative holding your power of attorney. A lawyer is mandatory only in court. “Immigration lawyer”, “immigration consultant” and “residence permit agency” are not professions with legal status but labels: the law protects only the titles abogado and gestor administrativo. So look past the label at who exactly handles your case and what they are accountable for.
Anyone can be your representative. Under article 5 of Law 39/2015 any person with legal capacity may represent you before the authorities. For applications and appeals the representation must be proven with a power of attorney — for example, an apud acta power granted at the online office (sede electrónica) or an entry in the register of powers of attorney. If it is missing, you get 10 days to fix it. Applications for the entrepreneur and digital nomad permits under Law 14/2013 are filed online by the applicant or through a representative.
What you cannot delegate. For the TIE card you go to the police in person to give fingerprints: the regulation expressly requires you to apply for it personally. Visa applications at a consulate are also made in person, with a representative only in exceptional cases (art. 26.1 RD 1155/2024).
Posing as a lawyer is a crime. Only a member of a bar association is a lawyer (arts. 4 and 7.1 of the Statute of the Legal Profession). The Criminal Code (art. 403) punishes practising a profession without the required qualification with a fine, and with six months to two years in prison if the person also publicly presents themselves as a professional. An “immigration consultant” has no such status — so you cannot hold them to a lawyer’s standards either.
Who you need at each stage of a residence permit
| Stage | Who can handle it | What matters |
|---|---|---|
| Choosing the ground and checking documents | an immigration lawyer or an experienced gestor | A wrong ground is the costliest mistake: refusal and a new application from scratch |
| Filing the application | you, a gestor, a lawyer or another representative with a power of attorney | The law does not require the representative to hold any status |
| Request for documents (requerimiento) | whoever put the file together | The deadline is in the letter, as a rule 10 working days. Notices go to whoever filed |
| Refusal: appeal to the same body or to a higher one | by law — you or a representative; in practice — a lawyer | One month. This is already a dispute, and the arguments in the appeal shape any court case |
| Court | only a lawyer; before a panel court also a procurador | Art. 23 of Law 29/1998 |
| Letter about cancellation | a lawyer | Usually 10–15 days to respond — the deadline is in the letter |
| TIE and fingerprints | only you in person | A representative can help book the appointment |
| Autónomo, taxes, returns | gestor or tax adviser | A dispute with the tax agency is for a lawyer |
A word on agencies. An agency is a company, and a company cannot be a member of a bar association. If an agency promises “legal support”, ask which lawyer or gestor will sign the documents and check their number as described below. If a refusal has already arrived, see residence permit refusal in Spain; if you received a cancellation letter, see residence permit cancellation.
What bar membership actually gives you
A bar number is not just decoration on a business card. There are three things behind it.
Verifiability. Any lawyer in Spain can be found in the Censo de Letrados register of the General Council of the Spanish Legal Profession (abogacia.es). The register is open to everyone, and you do not need to call anyone. There is nowhere to check an asesor: there is no register.
Professional secrecy. The Statute (art. 21.1) gives a lawyer not only the right but also the duty to keep secret everything they learn in the course of their work, and exempts them from having to testify about it. Secrecy covers facts, correspondence, data and documents (art. 22.1). A consultant without this status has no such protection — in proceedings they can be questioned about what you told them.
Disciplinary liability. You can complain about a lawyer to their bar association, and the complaint must be examined. There is nowhere to complain about an asesor except the ordinary courts.
How to check a lawyer in two minutes
Ask not for a “diploma” but for their bar number and city. Then:
- Open the Censo de Letrados register on abogacia.es — the common register of all bar associations in Spain.
- Find the person by surname or number.
- Check the name, the bar association and the status “practising”.
Large bar associations also have their own registers — for example, the Barcelona Bar Association (ICAB). The result should match in both. You can see how this looks in practice on our lawyer’s profile: Irina Firsova, ICAB No. 46.385 — the number is clickable and leads straight to the bar association’s register.
If, when you ask for a bar number, you are told “we are a law firm” or “we have lawyers on staff”, that is not an answer. A company cannot be a member of a bar association; only a specific individual can.
When a lawyer is required by law and when not
In civil proceedings the general rule of the Civil Procedure Act (LEC, arts. 23 and 31) is that you need both a lawyer and a procurador — a court representative. There are exceptions to the rule:
- Claims up to €2,000 — you can represent yourself.
- Over €2,000 — a lawyer and procurador are mandatory.
- Cases defined by the subject matter of the dispute (art. 250.1 LEC — for example, eviction) — a lawyer and procurador are mandatory regardless of the amount.
Outside court there is no obligation to hire a lawyer at all. You can apply for a residence permit, renew your card or get an NIE yourself or through a gestor.
You need a lawyer where a dispute arises. A refusal that has to be appealed. A demand from the authorities that you disagree with. A transaction where the other side is stronger and its lawyers have already drafted the contract.

Specialisations: who to go to for what
Spanish lawyers are divided by area of law, and the names of these areas are worth knowing: they are used to label the sections of law firm websites and to search the bar association register.
Immigration law — extranjería
Residence permits, renewals, changing grounds, citizenship, family reunification.
What a lawyer does: chooses the right ground for your case, prepares the file and handles correspondence with the authorities. In immigration cases the cost of a mistake is not a fine but a lost year: a new application starts from scratch.
When you specifically need a lawyer: a complex ground, a criminal record or past breaches of immigration rules, disputed family ties in reunification, a renewal after your circumstances have changed. A first application on a simple ground with all documents in order is a job for a gestor.
Administrative law — derecho administrativo
Appeals against refusals, disputes with the authorities, fines and penalties.
For Russian-speaking applicants this is most often a continuation of an immigration case: a residence permit refusal is appealed precisely here, under the rules of the immigration regulations. Deadlines are short and run from the date of notification, not from the date you read the letter.
When you specifically need a lawyer: for any appeal. The law lets you file an administrative appeal against a refusal yourself, but it is already a dispute: arguments you leave out are hard to add later in court, and in court a lawyer is mandatory. Bodies and deadlines are covered in residence permit refusal in Spain.
Property law — derecho inmobiliario
Buying and selling, renting, property checks, disputes with developers.
What a lawyer does: checks the property before you pay a deposit — encumbrances, debts for community charges and IBI (property tax), whether buildings are legal, third-party rights; reads the contract before signing; accompanies you at the notary.
Important: a notary in Spain certifies the transaction but does not protect your interests. They are neutral by virtue of their office.
Tax law — derecho fiscal
Tax residence, disputes with the AEAT (tax agency), double taxation.
When you specifically need a lawyer: a request or audit from the tax authorities, a dispute over residence, a case where two countries each consider you their resident. For an ordinary annual tax return an asesor is enough, and it is cheaper.
Commercial and corporate law — derecho mercantil
Company registration, autónomo (self-employed) status, contracts, conflicts between shareholders — the whole business side of relocation.
When you specifically need a lawyer: a shareholders’ agreement, buying a stake, a conflict between shareholders, a contract with a major counterparty. Registering an SL (limited company) with standard articles is a job for a gestor.
Family law — derecho de familia
Marriage and divorce, pareja de hecho (registered partnership), division of property, agreements concerning children, recognition of foreign judgments in Spain. Citizenship through marriage is a separate matter: it belongs to immigration law, but the reason for it is a family one.
When you specifically need a lawyer: almost always. Family cases go through the courts, where a lawyer’s involvement is mandatory.
Inheritance law — derecho sucesorio
Accepting an inheritance in Spain, inheritance tax, disputes between heirs.
When you specifically need a lawyer: heirs in different countries, a dispute over shares, a missed deadline for acceptance. Inheritance tax in Spain is regional and varies many times over between autonomous communities — a separate reason to do the sums in advance. Regional reliefs, deadlines and rules for non-residents are covered in our guide to inheritance and gift tax in Spain.
Criminal law — derecho penal
Charges, arrest, a case against you or your family members.
This also covers some situations involving the occupation of someone else’s home: they can be either criminal matters or a civil eviction dispute — and eviction, as shown above, requires a lawyer whatever the amount.
How to become a lawyer in Spain
The route is set by Law 34/2006 on access to the professions of lawyer and court representative:
- a Spanish law degree (Grado en Derecho);
- a master’s degree giving access to the profession (máster de acceso), including a traineeship;
- the state examination;
- admission to a bar association — under article 9 of the General Statute of the Legal Profession (RD 135/2021) this is also open to non-EU nationals who are legally in Spain.
A Russian law degree does not qualify directly: it first has to be recognised — through convalidación of part of the studies under RD 889/2022 leading to a Spanish degree, or homologation to Licenciado en Derecho — and only then can you enrol in the master’s. There are no official statistics on lawyers’ earnings in Spain.
How much it costs
There are no uniform fees in Spain: bar associations no longer set mandatory rates. The price depends on the type of case, its complexity and whether it goes to court.
What to look at rather than the figure:
- Hoja de encargo — a written engagement agreement. The lawyer must explain what they are charging for. No agreement means nothing to discuss.
- What is included and what is not. Government fees, sworn translation, apostille, certificates from another country and the procurador’s services are usually paid separately. Also ask about what happens along the way: answering a request for documents, an appeal after a refusal, a new application — are they in the price or a new contract?
- Payment method. A fixed fee per case, an hourly rate or payment in stages. Immigration cases are more often charged a fixed fee.
A promise of a result should put you on your guard. A residence permit approval, winning a case or a tax authority decision are not in the lawyer’s hands, and they are not allowed to promise them.
What to ask before you pay
These questions work for a lawyer, a gestor and an agency alike. A confident specialist answers them straight away and in writing.
- Who exactly handles the case — name, bar or association number and city. Not “our lawyers”, but one person.
- Which ground do you propose and why — and what risks do you see in my documents.
- What the price covers: consultation, document check, filing, answering a request for documents, an appeal after a refusal.
- In whose name and with whose digital certificate the application is filed, who receives the notices and how I can see them myself. An electronic notice left unopened for 10 calendar days counts as rejected (art. 43.2 of Law 39/2015), and the case moves on without your answer.
- What happens after a refusal: who writes the appeal, by when and at what cost.
- Is there a written agreement (hoja de encargo) and what are the refund terms.
If you are promised guaranteed approval, walk away. The decision on a residence permit is made by the authorities, not by whoever you hire.
Already working with a lawyer or a firm and unsure about your documents? You can send the package for a full review and second opinion: document by document, what is wrong and how to fix it, before you file.
Who handles cases for us
Immigration law — extranjería — is handled by Irina Firsova, a member of the Barcelona Bar Association, No. 46.385. She has practised since 2018 and holds a master’s degree in immigration law from the ICAB.
The number is public: check it in the ICAB register. We ask you to do so rather than take our word for it — earlier in this article we explain why verifiability is the main difference between a lawyer and a consultant.
For other specialisations — property, tax, commercial, family, inheritance and criminal law — we find a lawyer from our vetted network and stay in touch with you. We do not pretend that one person handles everything: that is not true in any legal practice.
If you do not know who you need, describe your situation in your own words. We will tell you whether you need a lawyer at all — sometimes a gestor is enough and cheaper — and, if you do, who will handle your case.
FAQ
Do I need a lawyer to get a residence permit in Spain?
Not by law: you can file a residence permit application yourself or through any representative with a power of attorney. A lawyer or gestor helps you avoid mistakes with the ground and documents, and a lawyer is mandatory only in court.
What is the difference between an immigration lawyer and an abogado in Spain?
“Immigration lawyer” as a label is not protected by law — anyone can use it. An abogado is only a member of a bar association: their number can be checked in a public register, they are bound by professional secrecy and answer to their bar.
Can a gestor file residence permit documents?
Yes. A gestor, like any representative with a power of attorney, can file the application and answer a request for documents. A gestor does not represent you in court — that requires a lawyer.
Who can appeal a residence permit refusal?
You can file the administrative appeal yourself or through a representative, within one month. Going to court requires a lawyer, and before a panel court also a procurador.
How do I check an immigration lawyer in Spain?
Ask for their bar number and city and look them up in the Censo de Letrados register on abogacia.es. If there is no number, the person is not a lawyer and there is nowhere to check their status.
Can I get a free lawyer in a residence permit case?
A foreign national who is in Spain can get free legal aid in court if their income is below the threshold of Law 1/1996 — twice the IPREM a year for a single person. The application is made to the bar association.
