Research residence permit in Spain: a doctorate instead of a student visa in 2026

The research residence permit is the Spanish residence granted under Article 72 of Law 14/2013 to people doing scientific work. Since 7 August 2026, management criterion 2/2026 has placed doctoral candidates in the same category: an official doctorate is now filed as a research residence permit rather than a student stay. UGE handles the case, the decision takes twenty working days, the permit runs up to three years, and the time counts towards permanent residence in Spain.

What changed in August 2026

Until now a foreigner admitted to a Spanish doctoral programme received the same status as a master’s student: estancia por estudios, a study stay. The Directorate-General for Migration Management took a different view in criterion 2/2026: a doctorate is research by its very nature, so the matching status is the residence permit for research under Article 72.2.b) of Law 14/2013.

Three consequences follow, and all of them matter.

  • The authority changes. The file goes to the Unit for Large Companies and Strategic Collectives, UGE, instead of the provincial immigration office. Filing is electronic.
  • The timing changes. Twenty working days instead of the usual months, and here silence from the authority means approval rather than refusal.
  • The status changes. A stay is not residence. For permanent residence and for citizenship that difference is decisive, and the table below sets it out.

The criterion covers both situations: arriving from abroad, and switching to the new status from inside Spain, without leaving, for those already living here legally on another permit.

Who the research permit fits

The route was not designed for doctoral candidates alone. Under Article 72 the host may be a public research centre, a company carrying out research and development, a body with a research cooperation agreement, or a university or other higher education institution. That gives three typical situations.

  • A doctoral candidate with no contract. There is an admission to an official doctoral programme but no salary. The candidate files the application personally and, instead of an employment contract, attaches a certificate of enrolment in a programme entered in the national RUCT register. The university may also file on their behalf.
  • A researcher with a contract. An agreement with a university, an institute or a company; the organisation files the application.
  • A scientist in a company doing R&D. The same procedure, with the employer as the host.

The route does not fit a bachelor’s degree, a master’s or a language course: those keep the student route. Nor does it fit someone who simply wants to live in Spain without research work — for that there are other grounds for Spanish residence. Figures, deadlines and requirements in 2026

What follows is set by the rules and by the ministry’s information sheet. The amounts are tied to the minimum wage, SMI, and are recalculated whenever it changes.

We deliberately do not quote the fee: the tariff changes by ministerial order and form 790 fills in the current amount itself. The funds benchmarks come from UGE guidance rather than from the law, so they are worth rechecking before filing — the authority moves them together with the SMI.

The length of the permit is set by the agreement with the university, not by the authority. A Spanish doctorate officially runs for three years of full-time study, but if the university signs a convenio de acogida for one year with annual extensions, the permit will be issued for one year. So the length of the agreement is something to settle with the university before filing rather than a formality: three years in a single permit save two extra filings with UGE and remove the risk of a gap in qualifying residence — and that residence is the real prize here, counting towards both permanent residence and citizenship.

Documents and how to file

The file is put together either by the host institution or by the candidate.

  • Form MIT-T, the application for a research authorisation.
  • A full copy of the passport.
  • The original of a criminal record certificate covering the last five years in the country of residence.
  • A convenio de acogida, the hosting agreement signed by both sides. It must state the title or field of the research, the commitments of the researcher, the commitments of the institution, and the start and end dates.
  • For a candidate without a contract, a certificate of enrolment in a doctoral programme entered in the RUCT register.
  • Proof of health insurance for a residence permit.
  • Evidence of sufficient funds.
  • The host’s tax number and a copy of the employment contract, where there is one.
  • The receipt for the fee.

Filing goes through the electronic office, so you need a digital certificate or another accepted way of signing in. If you have none, the criterion lets the university file the application instead.

The researcher’s family

A spouse or partner in a comparable relationship, minor children, adult children who depend on the holder and have not started a family of their own, and dependent relatives in the ascending line may obtain permits together with the researcher or later. The application uses form MI-F; the family permit is tied to the researcher’s and runs for the same period.

As a general rule for Law 14/2013 permits, the spouse and adult children may work as employees or on their own account without a separate authorisation. Information sheet 68 does not say so explicitly, so it is worth confirming the spouse’s right to work with UGE before filing — the family budget for the move often depends on it.

The point here is different: all else being equal, a doctoral candidate holding research status moves towards permanent residence, while a student does not.

What it gives you in the long run

Three years of residence with the right to work, a two-year renewal and permanent residence at the end of the fifth year make a complete route rather than a pause for the duration of a degree. For a family with capital, two further consequences matter.

  • Time towards citizenship. Years on a research permit count as legal residence, which is the direct path to Spanish citizenship. Years spent on a student stay are not converted retroactively: the clock starts when the status changes. If someone in the family is already in Spain on a study permit, the switch is worth discussing before the next renewal rather than someday.
  • Tax. A move usually makes the family Spanish tax residents, and then the regime applied to foreign income and assets starts to matter.   • Fallback routes. If the research ends sooner than your plans for Spain, there are neighbouring options: the highly qualified professional permit with a suitable job offer, and the job-search residence permit for graduates of Spanish institutions.

Do you need a contract with a university to get a research permit?

A contract is needed only if you are coming to work as an employed researcher.

How much money does a doctoral candidate have to show?

Can you switch to the research permit without leaving Spain?

Yes, if you are in the country legally on another permit. Criterion 2/2026 expressly covers both arrival from abroad and a change of status from inside. Years previously spent on a student stay, however, are not recalculated towards citizenship.

Can the spouse work in Spain?

As a general rule for Law 14/2013 permits, a spouse and adult children work as employees or on their own account without a separate authorisation. The ministry’s information sheet does not state this explicitly, so confirm with UGE before filing what exactly your family will receive.

Is travel insurance accepted for the application?

No. UGE warns expressly that travel insurance is not accepted. You need a certificate from an insurer authorised to operate in Spain, stating the period of cover.
