Valencia, Spain’s third-largest city, offers a wide network of notarial services for residents and foreigners. Notaries in Spain play a key role in legal processes, from buying property to handling inheritances and legalising documents. This is especially relevant for those planning to buy property in Spain or apply for a golden visa, a Spanish startup visa or a digital nomad visa. What is a notary in Spain?

A notary (Notario/Notaria) in Spain is a public official appointed by the Ministry of Justice (Consejo General del Notariado) who has the power to certify documents and transactions and give them legal force. Unlike in Anglo-Saxon countries, Spanish notaries are highly qualified lawyers who have passed a rigorous competitive selection.

The notary’s main functions:

Certifying property transactions — notarisation is mandatory when buying and selling property in Valencia and throughout Spain. The notary checks the legal capacity of the parties, the lawfulness of the transaction and whether the documents meet legal requirements. Note that costs can vary depending on the value of the property. Notary fees are usually paid by the buyer, but this can be negotiated as part of transaction support.

Wills and inheritance — drawing up wills (testamento), accepting an inheritance, dividing property between heirs. A Spanish notary ensures that the testator’s wishes are respected and the heirs’ interests are protected, including property in Spain and outside Spain.

Legalising documents — apostilling documents for use abroad, certifying copies, translations into Russian and signatures. Apostilles and translations into Spanish are especially important for foreigners preparing documents for use in other countries. If necessary, documents with a Russian translation can be certified through an official translator.

Corporate law — registering companies, amending articles of association, minutes of shareholders’ meetings, business purchase transactions. Notarial deeds are mandatory for most corporate actions.

Family law — prenuptial agreements (capitulaciones matrimoniales), property settlement agreements on divorce, recognition of paternity, consent for children to travel abroad.

Powers of attorney — drawing up contracts and general and special powers of attorney (poderes). You can grant a notarised power of attorney in Spanish to manage property or open a bank account. Many clients want a notarised power of attorney in Spanish so that someone can act in their name in various matters. The translation of the power of attorney and of the document into Spanish must be done by an official translator, which is paid for separately.

Russian-speaking notaries and Russian-language service in Valencia

How to choose a notary in Valencia

Selection criteria:

Location — choose a notary whose office is conveniently located for you. In Valencia notaries are spread across the city and suburbs. For example, the central district has many notary offices, including offices on Plaza Alfonso El Magnànim.

Specialisation — although all notaries are generalists, some specialise in particular areas (property sales, corporate law, international transactions). You will certainly find notaries who work with foreign clients in the city centre.

Language skills — for foreigners it is important to find a notary with an interpreter. Many notaries in Valencia work with English-speaking clients. If you are outside Spain and need to sign documents, a remote procedure is possible.

Reputation and reviews — study the ratings and client reviews (as in the table below). A high rating usually indicates professionalism and good service.

Online services — some notaries offer a preliminary consultation online, which saves time on preparing documents. You can request a preliminary consultation by email.

Cost of services — notarial fees in Spain are regulated by the state but may vary slightly. Each additional document and notarial service is charged separately.

How the process with a notary works

Preparing for the visit:

  1. Book an appointment — contact the notary by phone or through their website to book. State the type of service and a preferred date. You can also order services through our website.

  2. Prepare the documents — gather all the necessary documents: identity document (DNI, NIE or passport), property documents, previous contracts and so on. Where necessary, a document must be translated into Spanish by an official translator.

  3. Consultation — many notaries offer a preliminary consultation to clarify details and check documents. Legal help at this stage is critically important.

At the notary’s office:

Identifying the parties — the notary checks the identity of all participants in the transaction, their legal capacity and their right to carry out the notarial act. Para poder (in order to) complete the transaction, all documents must be in order.

Explaining the document — the notary explains in detail the content of the document, the ownership rights, the rights and obligations of the parties and the possible consequences. This is one of the key moments — making sure all parties understand what they are signing.

Signing — once all parties have agreed, the document is signed in the presence of the notary. The notary adds their signature and seal, giving the document legal force.

Registration — depending on the type of document, the notary may send it to the relevant registry (for example, the Land Registry for property transactions in Valencia).

After the visit:

Receiving copies — you receive certified copies of the document (copia autorizada or copia simple), which have legal force. The notarial copy can then be used to register ownership rights.

Safekeeping — the original document remains in the notary’s archive, which keeps it safe and makes it possible to obtain duplicates in the future.

Cost of notarial services

Notarial fees in Spain are regulated by royal decree and depend on the type of service and the value of the transaction. Below are the basic costs:

  • Property purchase: 0.3–0.5% of the property value (minimum 60–90 euros)
  • Simple power of attorney: 30–60 euros
  • General power of attorney: 150–300 euros
  • Will: 35–60 euros
  • Setting up a company: 150–600 euros depending on the capital
  • Apostille: 3–10 euros per document

Specifics for foreigners

Obtaining an NIE:

For most notarial acts foreigners need an NIE (Número de Identificación de Extranjero) — the foreigner identification number. A notary can help draw up a power of attorney for obtaining an NIE. Language barrier:

If you do not speak Spanish, you need to bring an official translator (traductor jurado). Some notaries arrange translation services themselves. An interpreter usually costs 50–150 euros an hour and is paid separately. A document must be translated into Spanish by an official translator.

Tax obligations:

When you buy property the notary informs you of your tax obligations but is not responsible for paying them. You will need to go separately to a tax adviser (asesor fiscal) to deal with tax returns.

Legalising foreign documents:

Documents issued in other countries must be apostilled or legalised through a consulate and translated by an official translator. The apostille and translation into Spanish are mandatory steps.

Property transactions in Valencia and on the Costa Blanca

Buying property

Video conferencing — online meetings are available for preliminary consultations and some procedures (powers of attorney for foreigners). This is especially convenient if you are abroad.

Online booking — most modern notaries offer appointment booking through their website or by email.

Electronic access to documents — the option to receive electronic copies of notarial documents through secure online platforms.

  1. Book in advance — popular notaries may be booked up several weeks ahead, especially in the property sales season (spring–summer).

  2. Check the cost — although fees are regulated, always confirm the final cost before the procedure starts; additional costs may include an interpreter and urgency. The notary’s services are paid separately from other legal services.
