Russian criminal record certificate for a Spanish residence permit: validity, apostille, Gosuslugi

A certificate of no criminal record is required for almost every Spanish residence permit: the digital nomad visa, no lucrativa (non-lucrative residence), studies longer than six months, family reunification and work. The Russian certificate is issued free of charge by the Russian Ministry of Internal Affairs (MVD), but Spain will only accept a paper certificate with an apostille and an official translation, and the consulate requires it to be no more than three months old on the date you apply. Because of this time limit, the certificate is planned backwards from the application date: order it so that the apostille and translation are done before three months have passed. Which certificate you need for a Spanish residence permit

Spain asks for a certificate not only from your country of citizenship but from every country where you have lived. The period depends on the type of permit:

The rule for digital nomads and the other Ley 14/2013 permits is in Article 62 of that law; for no lucrativa, it is in the information sheet of the Ministry of Inclusion. A certificate is also required for family reunification, employment and self-employment. How long an apostilled criminal record certificate is valid

The Consulate General of Spain in Moscow states it plainly: a criminal record certificate is valid for three months from the date of issue. The apostille does not extend this: an apostille has no validity period of its own, but if the document’s validity is limited, the apostille’s is the same. The three months run from the date on the certificate, not from the date of the apostille or the translation.

Neither the law nor the ministry’s information sheets for applications made inside Spain set a period in months, but an outdated certificate is a common reason for a request for further documents. A safe rule for any application: the certificate is no more than three months old on the date you apply.

The three months run from the date on the certificate. The application is marked in terracotta: by then the certificate must already have its apostille and translation.

Paper or electronic certificate

Under the MVD’s administrative regulations (Order No. 660 of 27 September 2019), the certificate comes in three forms:

  • Electronic: signed with the MVD’s enhanced qualified electronic signature and delivered to your Gosuslugi account. It is enough for Russian organisations, but an apostille is placed on a paper document, so it does not work for Spain.
  • Printout from an MFC (Russian public service centre): a paper document confirming the content of the electronic certificate. It is not an information centre form, and it is better not to get this one for the apostille.
  • Paper certificate on an official form: a numbered form with security background printing, issued by the regional information centre of the MVD (IC) or by the Main Information and Analytical Centre of the MVD (GIAC). This is the one you need for Spain.

The certificate is issued free of charge. It takes up to 30 calendar days from registration of the application, and this can be extended if necessary. A ready paper certificate is kept at the IC for three months from the date the application was registered.

How to order the certificate via Gosuslugi

  1. On Gosuslugi (the Russian public services portal), open the service “Certificate of having (not having) a criminal record”.
  2. Fill in the application: personal details, including any previous surnames, and your residential addresses.
  3. Choose to receive the certificate on paper at an MVD information centre. If you do not live in Russia, choose the centre in the city where your representative will collect it.
  4. When the certificate is ready, a notification with the place and time of collection arrives in your account.
  5. Collect the certificate in person or through a representative holding a power of attorney.

You can also apply in person at the MVD or an MFC, but an MFC issues a printout of the electronic certificate, so for Spain it is better to choose collection of the official form at an IC from the start.

Apostille on the certificate: where, how much and how fast

  • Who issues it. The information centre that issued the certificate, or the GIAC of the Russian MVD in Moscow (ul. Novocheryomushkinskaya 67). The GIAC also apostilles certificates from other regions: it checks the signature against a specimen, and if it has no specimen, it requests one, which can lengthen the process.
  • Processing time: up to five working days from the day the documents are submitted (Federal Law No. 330-FZ, Article 6). If a signature specimen has to be requested, the period is extended to 30 working days.
  • State fee: RUB 2,500 per document (Article 333.33(1)(48) of the Russian Tax Code). The amount has not changed for 2026.
  • Online application for an apostille is not possible. Via Gosuslugi you can book an appointment to submit documents at an IC or the GIAC and pay the fee.
  • Who collects it. The apostilled document is handed to the applicant or their representative against a signed receipt.

Moscow: Velozavodskaya, the ZIC and the GIAC

In Moscow, the role of the regional information centre is performed by the Zonal Information Centre of the Main Directorate of the MVD for Moscow (ZIC). Its criminal record certificate office is at ul. Velozavodskaya 6a, near Avtozavodskaya metro station. It issues certificates to Moscow residents and apostilles certificates issued by this centre. The GIAC is the federal centre at Novocheryomushkinskaya 67. Go there if your certificate was issued by the IC of another region but it is more convenient to get the apostille in Moscow.

Translation into Spanish

Spain does not accept a notarised translation certified in Russia. The Consulate of Spain in Moscow recognises three routes:

  1. a translation by a sworn translator (traductor jurado) appointed by the Spanish Ministry of Foreign Affairs, which is official in itself; the list of translators is kept by the Spanish Ministry of Foreign Affairs;
  2. a translation certified at the Consulate General of Spain in Moscow or Saint Petersburg, with the signature recognised by the legalisation service of the Spanish Ministry of Foreign Affairs;
  3. a translation prepared by a Russian consulate in Spain, with the consul’s signature recognised by the same service.

The consulate itself does not translate. In practice, sworn translators translate the certificate together with the apostille, and that is how you should order it.

If you are already in Spain

You can order the certificate via Gosuslugi from abroad if you have access to the portal. But the paper certificate is issued only at an IC or the GIAC, so someone in Russia has to collect it and get the apostille: your representative with a power of attorney. The power of attorney can be drawn up by a notary or at a Russian consulate. The representative collects both the certificate and the apostilled document.

A consular certificate from the Russian Embassy in Spain is not suitable for a residence permit: Spain requires a certificate from the country’s authorities with an apostille, that is, an MVD certificate.

Common mistakes

  • The certificate “expired”. It was ordered first, then a month went by waiting for an appointment, the apostille and the translation, and by the time of application more than three months had passed. Plan the certificate’s validity backwards from the application date.
  • An electronic certificate or an MFC printout instead of an IC form: it cannot be apostilled.
  • Only a Russian certificate, although you lived in another country for the last two or five years.
  • A notarised translation instead of a sworn one.
  • The apostille is not translated: translate the whole document.
