A Spanish residence permit on your own or with a lawyer: where the line runs

You can apply for a Spanish residence permit yourself: the law requires neither a lawyer nor an agency. The application is filed by the applicant: under Law 14/2013 through the UGE account on the Ministry of Inclusion portal, and under the general regime through the Mercurio platform. The question is not whether it is allowed, but where a mistake costs more than a fee.

The line runs roughly here: the basic steps — NIE, appointments, padrón, fees — are done alone with no risk at all. Deadlines that cost you the status, and replies to additional requests, are where doing it alone gets expensive.

What the law says about applying yourself

Spanish law assumes the applicant acts in person and that a representative is their own choice. Under Article 5 of Law 39/2015 anyone with legal capacity may act through a representative, but for filing applications, appeals and waivers the representation must be evidenced; for routine procedural steps it is presumed. In other words, there is no mandatory «accreditation through a lawyer» in immigration cases.

The technical side: applications under Law 14/2013 — nomad, highly qualified, startup, investors, intra-group transfers — are filed electronically with UGE through an account on the Ministry of Inclusion portal, and the applicant can file them. General-regime applications — non-lucrative, family reunification, work, arraigo, renewals — go to the provincial immigration office through Mercurio: different ministries, different forms and different fees. These steps are predictable: a clear list, a fixed fee and the chance to redo them. If you live in Spain, can read a form in Spanish and are not in a hurry, the saving is real.

Where a mistake costs more than the fee

  • An additional request. You get ten days to reply. A missed or incomplete answer is then judged on the merits, not treated as a technicality. Typical requests are covered in the article on refusals.
  • Renewal deadlines. General regime: two months before the card expires and up to three months after (RD 1155/2024). UGE permits have their own window — 60 days before and up to 90 after, and once it passes the renewal is refused and the case starts over (nomad renewal).
  • Insurance. A policy with co-payment, waiting periods or from a foreign insurer is the most common trigger for an additional request on the nomad route, even though the instruction does not say so. What qualifies is in the article on health insurance.
  • Social security and length of service. An employee needs a certificate of applicable legislation; a freelancer needs proof of work with foreign clients. The requirements are set out in the nomad guide.
  • Refusal and appeal. One month for reposición, two for the court. While the dispute runs, the status may be in question, and once the deadline passes it can be cancelled.
  • UGE silence. A decision is due within 20 working days and silence counts as approval — but it has to be recorded properly and turned into a card: what to do when there is no decision.

Filing on your own, step by step

A plan for those already in Spain applying under Law 14/2013 — nomad, highly qualified, startup. A consular application follows a different order: the documents go to the visa section where you live.

  1. Check the ground first. Before collecting papers, make sure you meet the income, service and employment requirements: they are gathered in the article on Spanish residence permits.
  2. Get an NIE if you do not have one, and set up a digital certificate — electronic filing is impossible without it.
  3. Collect the applicant’s documents: passport, criminal record certificate with apostille and sworn translation, proof of income, contracts and statements.
  4. Arrange insurance with a Spanish insurer, without co-payment or waiting periods.
  5. Pay the fee under the right code of form 790 — for UGE permits that is 038, and it is paid before filing (the 790 fees).
  6. Fill in and sign the application in the UGE account using Autofirma, attaching the documents as one set (under the general regime the same step is done in Mercurio) (Mercurio versus UGE).
  7. Watch the notifications. An additional request arrives in your account, not by email, and the deadline to reply is ten days.
  8. Once approved, book the fingerprint appointment, pay the card fee and collect the TIE (the TIE card).

If at any step the answer is «not sure», that is exactly where a consultation is cheaper than redoing the work.

What it costs alone and with support

Doing it yourself is not free: fees, translations, apostilles and insurance are paid either way. The difference is the cost of your time and the price of a mistake.

The comparison is not «a fee against zero» but «a fee against the cost of refiling and months of waiting». For a simple case — one applicant, employment, clean documents — the balance favours doing it yourself. For a family, freelancing with several clients, or a renewal with a gap in social security, it usually does not.

Why forum advice and classified ads are risky

Forums are useful as a source of observations and useless as a source of rules: they describe individual cases, often out of date. Real examples we have checked against documents:

  • «You need a contract for at least three years» — no such requirement exists in the law, yet it travels from article to article.
  • «You must have lived in Spain for six months before applying» — that is consulate practice, not the text of the instruction.
  • «You can hold residence without living in Spain» — true for the golden visa, which has been abolished; every current route has its own presence requirements.

Classified ads offering to «arrange residence» are a separate matter. Check responsibility rather than promises: who signs the contract, who is named as representative in the application, what happens if it is refused. An intermediary without legal standing bears no responsibility and does not appear in the file.

How to check whoever you are paying

  • Standing. A lawyer belongs to a bar association, and that is in an open register: our legal side is run by Irina Firsova, Barcelona Bar Association № 46.385 — check the register.
  • The contract. It should say what the work covers, what happens on an additional request and on a refusal, and who pays for refiling.
  • Representation. Ask who will be named as representative and how it is formalised: under Article 5 of Law 39/2015 representation is evidenced by a document.
  • Honesty about timing. A promise to «get it approved in a week» contradicts the rules: UGE has 20 working days, and provincial offices have their own.

Can you get a Spanish residence permit on your own?

Yes. The applicant files the application, and no lawyer is required by law. Can you trust forum advice about Spanish residence permits?

As observations, yes; as rules, no. Forums keep repeating outdated requirements such as a three-year contract or six months of residence before applying, which do not appear in current documents. Check against ministry instructions and the regulation.

What happens if you file alone and get an additional request?

You have ten days to reply. An incomplete or late answer means the application is decided on what is already in the file — usually a refusal. After that only appeals remain: one month for reposición, two for the court.

Can you apply for a Spanish permit from abroad?

From outside Spain you file a consular application — a national visa on your chosen ground. Electronic filing with UGE or through Mercurio assumes you are in Spain and hold a digital certificate. Which is better depends on the route: filing from inside Spain on the nomad route gives a three-year card straight away.
