If you file a Spanish tax return late on your own, before the tax agency sends any demand, there is no penalty: a surcharge of 1% per month applies, and after a year 15% plus interest. If the tax agency finds the breach, the penalty starts at 50% of the unpaid tax, with reductions for agreeing and paying quickly.
This most often happens to people who have moved: digital nomads who did not file for their first year, owners of a flat in Spain who did not know about Form 210, and those who forgot to declare assets abroad. Below: how a surcharge differs from a penalty, how to file a return for a past year, what changes if the tax agency found the mistake first, and how it affects your residence permit renewal.
Surcharge or penalty: the difference
One thing decides it: whether you filed before the tax agency officially took an interest in your case. A demand is any action by the tax agency on that tax and period that you have been formally notified of — a letter, a request for documents, the start of an audit (Article 27 of the General Tax Law LGT).
An example: you did not declare income on which €20,000 of tax is due. If you file yourself 7 months late and pay at once, you pay €1,200 on top of the tax. After 18 months — €2,656: €2,250 of surcharge and €406 of interest. If after the same 18 months the tax agency finds it, the penalty with all reductions is €4,200, plus €1,219 of interest — €5,419 in total on top of the tax. Without reductions the penalty would be €10,000.
How to fix it yourself before a demand
- A surcharge instead of a penalty. 1% plus another 1% for each full month of delay; after 12 months — 15%, with interest for the time after the 12th month. There is no penalty (Articles 27 and 179.3 LGT).
- A 25% reduction. The surcharge is cut by a quarter if the tax itself is paid on the day you file and the surcharge is paid within the deadline in its notice.
- Interest. In 2026 — 4.0625% a year (Article 26 LGT; the rate comes from the 2023 budget, which keeps being extended).
- The limitation period is 4 years from the day after the filing deadline (Articles 66–67). Filing late interrupts it, and the 4 years start again (Article 68.1.c).
How to file a return for a past year
- Open Renta WEB in your tax agency account and choose the past year (Ejercicios anteriores). You log in with a digital certificate or Cl@ve — how this works is covered in our article on the Sede electrónica.
- Complete the return for that year — Form 100, or Form 151 under the Beckham Law. More on Form 100 in «Modelo 100».
- Pay on the day you file: otherwise a second surcharge for non-payment is added to the late-filing one.
- If a return was filed but contains a mistake: for 2024 and later you file a single corrective return (autoliquidación rectificativa) — whether the tax goes up or down; for 2023 and earlier, a supplementary return (complementaria) if more is payable, or a request for rectification if less.
Form 210: non-residents with a flat in Spain
An owner of a flat who does not live in Spain pays tax every year on imputed income or on rent via Form 210. In 2026 the deadlines changed: imputed income for 2025 is declared by 31 December 2026, for later years from 1 April to 31 December of the following year, and rent in one annual return from 1 to 20 April. Lateness with tax payable means the same surcharge if you file before a demand. More in «Non-resident tax in Spain».
Form 720: assets abroad
Since the 2022 judgment of the EU Court of Justice, the special Form 720 penalties have been abolished: the general rules apply — a fixed amount per item of data, halved if you file before a demand, and the usual 4-year limitation period (Law 5/2022). The calculation by the three asset groups and what to do if you have not filed for several years are covered in «Modelo 720 and 721».
If the tax agency finds the breach
- Tax underpaid — a penalty on the unpaid amount: 50% if it is up to €3,000 or there is no concealment; 50 to 100% if it exceeds €3,000 and there is concealment; 100 to 150% if fraudulent documents were used (Article 191). Plus interest for the whole period of delay.
- Return not filed but no tax payable — a fixed €200 penalty; for information returns — €20 per item of data, from €300 to €20,000 (Article 198). Halved if you file before a demand. Which information returns a company files is listed in the article on SL company tax filings in Spain.
- Incomplete or incorrect return without loss of tax — €150 (Article 199); an unjustified refund claim — 15% of the amount claimed (Article 194).
Penalty reductions
Penalties under Articles 191–197 are reduced by 30% if you accept the audit findings, or by 65% under an agreement with the inspectorate. On top of that, another 40% off if you pay on time without appealing. Fixed penalties under Articles 198–199 get only the 40% reduction (Article 188 LGT). In practice: on a small quarterly return, a 50% penalty after both reductions becomes 21% of the underpayment.
If the debt is not paid on time at all, an enforcement surcharge is added: 5% if paid before the enforcement order, 10% within the deadline in the order, 20% later (Article 28).
Tax agency letters arrive in your account and in DEHú. An official notification left unopened for 10 days is treated as delivered, and deadlines run without you — so register your email in DEHú and check it.
What this means for your residence permit
Renewing a digital nomad permit and other permits increasingly requires Spanish tax returns for the years of residence and a certificate of no tax debts. A missing return is a frequent reason for a request for documents. It is better to fix it in advance: the five steps are set out in the plan in our article on digital nomad permit renewal. Frequently asked questions
What is the penalty for filing a tax return late in Spain?
If you file yourself before a demand from the tax agency, there is no penalty: a surcharge of 1% plus another 1% for each full month of delay, and after 12 months 15% plus interest. If the tax agency finds the breach, the penalty starts at 50% of the unpaid tax, with reductions for agreeing and paying quickly.
How does a surcharge differ from a penalty?
A surcharge applies when you yourself file late before a demand from the tax agency; there is no penalty in that case. A penalty is imposed when the tax agency finds the breach. The surcharge is almost always several times smaller.
How do I file a tax return for a past year in Spain?
In Renta WEB choose the past year, complete Form 100 or 151 and pay on the day you file. A return already filed for 2024 or later is corrected with a single corrective return, and for 2023 or earlier with a supplementary return or a request for rectification.
How many years back can the Spanish tax agency check?
Four years from the day after the filing deadline. If you file a return later, the period is interrupted and the four years start again.
What reductions apply to a tax penalty?
A penalty for non-payment is reduced by 30% if you accept the audit findings and by another 40% if you pay on time without appealing. Fixed penalties get only the 40% reduction.
What happens if I do not file Form 720?
Since 2022 the general rules apply: a fixed amount per item of data — €20, from €300 to €20,000, halved if you file before a demand. The special penalties and open-ended audits for Form 720 have been abolished.
Will a missing tax return affect my residence permit renewal?
It may: renewals increasingly require Spanish tax returns for the years of residence and a certificate of no tax debts. It is better to file the missing return before renewal — then it is a surcharge, not a penalty.
Key points about Spanish tax penalties
- Filed yourself before a demand — a surcharge of 1% per month, after a year 15% plus interest, with no penalty; paying on the day you file takes another 25% off.
- Found by the tax agency — a penalty from 50% of the underpayment plus interest; the 30% and 40% reductions bring it down to 21%.
- The limitation period is 4 years, and a late filing restarts it.
- For 2024 and later, mistakes are fixed with a single corrective return.
- The special Form 720 penalties were abolished in 2022.
