Yes, you can register in RETA with a past date: social security treats it as a late registration. The missed months cost the minimum-base contribution — €299.56 a month in 2026 — plus a 20% surcharge, and the €88.64 reduced rate is usually withdrawn. For a digital nomad whose gap surfaces at renewal, that means several thousand euros.
This concerns people who hold the Spanish digital nomad permit and work for themselves. UGE expects you to be in Spanish social security from the day after approval. The gap between approval and registration has become the main trigger for document requests at renewal, and at worst UGE terminates the permit — yours and your family’s. For a family with two children and a long lease, the stake is not a few thousand euros but the whole move.
From which day a digital nomad must be in RETA
From the day after the permit is approved: that is how UGE reads the rule at renewal. UGE’s FAQ on digital nomads says self-employed holders register in the self-employed scheme (RETA) themselves, and if they did not do so right after the permit was granted and a later check finds out, the permit is terminated — for the holder and the family members (questions 6 and 7). The legal basis is article 62.5 and additional provision 7 of Law 14/2013: the permit conditions go hand in hand with tax and social security obligations. When you apply, you sign a commitment to meet them “before the activity starts” (2023 joint instruction).
Social security in your home country does not replace RETA for the self-employed. For employees, UGE accepts a certificate of coverage under a social security agreement; for the self-employed it says there is no such substitute. A few cases where a home-country contribution record helped at renewal are described in our article on renewing the digital nomad permit, but you should not rely on them.
A digital nomad employed by a foreign company does not register in RETA: the company registers them as an employer with no establishment in Spain. If the company was late, moving the date and paying is its obligation, but at renewal the question still comes to you. How social security works in both cases is covered in digital nomad taxes in Spain.
What happens when the registration date is moved back
Moving the date is not correcting a typo. For social security it is a late registration (alta fuera de plazo), and it has four consequences.
- Minimum base, no adjustment. From the registration date to the end of the month in which you applied, the base is the minimum of the first band of the general table, €950.98 in 2026, so the contribution is €299.56 a month. There is no year-end adjustment to your real income for this period, up or down (article 44.3.c of RD 2064/1995).
- Late-payment surcharge. Past months are paid with a 20% surcharge if you pay within the deadline in the social security demand, and 35% if you miss that too (article 30 of the General Social Security Law).
- The reduced rate. It has to be requested at the time of registration (article 38 ter.3 of Law 20/2007), and only someone with no social security debt on the date it is granted can get it (article 20.1 of the General Law). A late registration means a debt for past months, and social security withdraws the reduced rate on that ground — including one already applied. The first year is then recalculated on your real income.
- A fine. The law treats late registration without an inspection as a serious offence: €751 to €7,500 (articles 22.7.b and 40.1.b of the Law on Social Order Offences). If an inspection found it, the fine starts at €3,750.
How the reduced rate and the contribution bands work is covered in autónomo taxes and contributions and changing your contribution base.
What moving the date costs: a worked example
Example: a self-employed digital nomad with net income of €5,000 a month — the €4,050–6,000 band in the 2026 table, minimum contribution €545.59 (Orden PJC/297/2026). 3 months passed between approval and registration, and the registration was filed in month 4. We count 15 months after approval: for someone who registered late, their own reduced-rate year runs up to that point, and that is the year that gets recalculated.
| Scenario | How it is charged | 15 months | Extra vs on time |
|---|---|---|---|
| Registered in RETA the day after approval | 12 reduced months at €88.64, then 3 months at €545.59 | €2,700.45 | — |
| Gap noticed early, date moved back, reduced rate kept from the date of payment | 4 months at €299.56, with a 20% surcharge on 3 of them — €1,377.98; 8 reduced months; then €545.59 | €3,723.87 | €1,023.42 |
| Gap noticed early, date moved back, reduced rate withdrawn | €1,377.98 for the first 4 months; 11 months at €545.59 | €7,379.47 | €4,679.02 |
| Gap found at renewal, reduced-rate year recalculated | 12 months at €88.64 already paid; 4 months recalculated at €299.56 and 11 at €545.59, the difference paid with a 20% surcharge | €8,426.94 | €5,726.49 |
On top of that come gestor fees and, if social security sees fit, a fine. Back-paid contributions reduce an autónomo’s taxable income, so part of the cost comes back through tax, but agree with your gestor which year they belong to. In practice it can cost more: in one reported case a three-and-a-half-month gap came to about €8,150 including tax and gestor fees (details in our article on digital nomad renewal). The higher your income, the more the lost reduced rate costs: from €6,000 a month the minimum contribution is €607.35.
Can you keep the reduced rate
Social security says no: a late registration means a debt on the date the reduced rate is granted. But on 24 April 2025 Spain’s Supreme Court (judgment 468/2025, appeal 909/2022) ruled otherwise. With a late registration, the reduced rate applies if there is no debt on the date it is granted — from the moment the autónomo paid it off. The court dismissed the social security appeal. If the reduced rate has already been refused and the debt is paid later, that does not restore the right.
So if you notice the gap in the first months, move the date at once and ask for the reduced rate in the same application. Pay the charges the day you receive them. If social security refuses, appeal (recurso de alzada) within a month citing that ruling (article 122 of Law 39/2015). The reduced rate runs for 12 months from the registration date, so at renewal, a year or two later, there is nothing left to keep. There is no guarantee: the case concerned a company partner in 2020, and with digital nomads social security currently takes the opposite line.
If the gap surfaces at renewal
It usually comes as a UGE document request: prove RETA registration from the day after approval and payment for the whole period. You have 10 working days to reply. There are three options, often combined.
- Move the date and pay. The safest answer in law. A Madrid High Court judgment of 20 April 2026 (TSJ Madrid, 384/2026) concerned exactly a digital nomad: UGE terminated his permit because he had paid no contributions from October 2023 to May 2024. He applied to social security for registration backdated to the approval date and paid for the period, and the court set the termination aside: a backdated registration has effect “for all purposes” and binds UGE (article 39 of Law 39/2015).
- Explain the reason. If the delay had a personal reason backed by documents — you left Spain after approval, medical treatment — permits have in practice been kept without moving the date. What works is a link of two statements: the reason with documents, and that you carried out no activity in those months and registered in RETA when you resumed it; write the second only if your bank statement shows no payments from clients for those months. Explanations like “we were waiting for a fingerprint appointment” do not help, practitioners say. How to write such an explanation is covered in the renewal article.
- Prepare another status in parallel. While your card is valid, you can apply to modify the permit to self-employed (cuenta propia): if renewal is refused, that application is already under way.
Moving the date is not instant: an application to social security, the charges, payment, a new employment record and a no-debt certificate. In cases reported in chats this does not always fit into 10 working days, and proof that the application was filed is sometimes not enough. So check the dates three to four months before your card expires.
How to move the date: the steps
- Download your employment record (vida laboral) and compare the RETA registration date with the date of the UGE resolution.
- File an application with the General Treasury of Social Security through its e-office (other applications to TGSS): ask for the registration date to be set to the day after approval, for the payment documents, and for the reduced rate to be applied.
- Pay the charges the day you receive them.
- Get a new employment record and a social security no-debt certificate dated after the payment.
- Check with your gestor the activity start date in your tax registration (modelo 036) and your income tax returns.
- Upload everything to UGE in reply to the request, or attach it to your renewal application with a one-page timeline.
- If social security refuses the reduced rate, appeal within a month.

How to avoid it: the order after approval
- Before approval. Set up e-filing access (a digital certificate or Cl@ve), choose your activity code and estimate your net income for the year. UGE recommends registering through an entrepreneur support point (PAE): you come with your resolution, and the tax and social security registrations are done as one package through the CIRCE system (question 8 of UGE’s FAQ).
- On the day of approval. Open a Spanish bank account: contributions are debited from it. The UGE decision is enough; you do not need to wait for the TIE card.
- The next day. Register with the tax agency (modelo 036) and in RETA with the activity start date set to the day after approval. Tick the reduced rate in the same application: it will not be granted later. How to fill in the fields is covered in how to register as an autónomo.
- Straight after. Download your vida laboral and check the registration date against the resolution date. A wrong date is easier to fix in the first month than at renewal.
- If you cannot register at once. For example, you leave Spain for a month after approval. Keep proof — tickets, medical documents: you will need them for an explanation at renewal.

Frequently asked questions
Can you register as an autónomo with a past date?
Yes. Social security accepts a registration with a past date and treats it as a late registration: the missed months go on the minimum base with no adjustment, with a surcharge, and in social security’s view the reduced rate does not apply.
Do you lose the tarifa plana with a backdated registration?
In social security’s view, yes. In 2025 the Supreme Court (judgment 468/2025) allowed the reduced rate from the date the debt for past months is paid, if it has not yet been refused. So pay the debt at once and appeal a refusal within a month.
How much does moving the RETA registration date cost?
Each missed month in 2026 costs €299.56 plus a 20% surcharge. If a 3-month gap surfaces at renewal and the reduced-rate year is recalculated, with income of €5,000 a month the extra is about €5,730 compared with registering on time. Add gestor fees and a possible fine from €751.
From which day must a self-employed digital nomad register with social security?
From the day after the permit is approved. UGE states that you must register straight after the permit is granted, and if a check finds no registration, the permit is terminated for the holder and the family.
Do contributions in my home country replace RETA registration?
Not for the self-employed: UGE expressly rules out that substitute for people working for themselves. A certificate of coverage under a social security agreement is accepted only for employees. The few cases where it helped at renewal are exceptions, not the rule.
What happens if UGE sends a request and I do not move the date?
You can reply with an explanation and documents showing a personal reason for the delay — in practice this sometimes works. If it is not accepted, UGE refuses the renewal or terminates the permit. Moving the date and paying is the safest answer: in 2026 a Madrid court set aside the termination of a digital nomad’s permit precisely after such a move.
Can back-paid contributions be deducted as an autónomo expense?
Yes, social security contributions reduce an autónomo’s taxable income. Surcharges and fines do not. Which year to put the back payment in is best agreed with your gestor before you file the return.
Does this apply to an employed digital nomad?
They do not register in RETA themselves: the foreign company registers them as an employer with no establishment in Spain. If the company was late, moving the date and paying is its obligation, but at renewal UGE will still check whether you were in the system from the day after approval.
