After a French visa D refusal there are two routes, and they can run in parallel. The first is a complaint to the CRRV in Nantes: within 30 days, by post and in French, and no court case is possible without it. The second is a new application with a corrected file, which means paying the €99 fee again.
The choice depends on what the refusal says. If the consulate pointed to a missing document or unconvincing funds, it is quicker to fix the file and apply again. If the refusal is formulaic and the file was complete, the complaint puts your arguments on record and opens the way to court. The deadlines are short, so the decision is made in the first days after the refusal, not after weeks of thought.
What the refusal says and why it matters most
Every French visa refusal must state its reasons (service-public, France-Visas). The decision gives a ground and the rule the consulate relies on. For a Schengen visa the grounds are ticked on the standard form under Article 32 of the Visa Code; a national visa D has no single coded list, so the grounds are written out. The most common are:
- The purpose and conditions of the stay are not proven, or the information is judged incomplete or unreliable.
- A risk of misusing the visa: staying on after it expires, or doing something other than what it was issued for.
- Insufficient funds, or their origin not shown, a frequent ground for the visiteur visa.
- A threat to public order, or an entry ban in the Schengen Information System (SIS).
If the consulate has not answered within two months of the file being lodged, that is an implicit refusal, and it is challenged the same way. The reasons for an implicit refusal can be requested within the appeal period, and must be given within one month (CRPA, Article L232-4). Even a strong ground does not switch off the consulate’s checks: according to service-public, even the spouse of a French national can be refused for a sham marriage or a threat to public order.
Appeal or reapply: a comparison
| Point of comparison | CRRV complaint and court | New application |
|---|---|---|
| Deadline | 30 days for the complaint, then 2 months for the claim | None, you can apply at any time |
| Where | CRRV in Nantes, by post; then the Nantes administrative court | The consulate or visa centre where you legally reside |
| Cost | No fee; a lawyer is optional | A fresh €99 fee per person, plus the visa centre fee |
| What it gives you | A review of the refusal’s legality; if annulled, the court can order the visa issued or the application re-examined | A new decision on a file with the weak points fixed |
| When it makes sense | The file was complete and the refusal formulaic or wrong | The refusal points to a gap that documents can close |
In practice, many talent passport applicants do not appeal after a refusal but reapply with a stronger file; different people in relocation chats have described this since 2023. But if a court case may follow, the CRRV complaint is worth filing anyway: a missed 30-day window cannot be reopened.
The CRRV complaint: 30 days and a strict form
The Commission de recours contre les décisions de refus de visa d’entrée en France hears complaints against long-stay visa refusals. The procedure is set by Articles D312-3 and D312-4 of CESEDA, and the practical rules are on France-Visas and service-public:
- The deadline is 30 days from notification of the refusal or from the date of an implicit refusal. Until 2023 it was two months, and older texts still repeat that.
- By post only: CRRV – BP 83609 – 44036 Nantes Cedex 1. Send it by registered post with proof of delivery and keep that proof: without it the court may later reject the claim as inadmissible.
- Form: in French, signed, with arguments of fact and law, a copy of the refusal and every useful document.
- Who files: the applicant, their lawyer, or anyone with an interest, such as a family member.
- Compulsory: without a CRRV complaint, a court claim is inadmissible.
The commission either rejects the complaint or recommends that the foreign and interior ministers issue the visa. A complaint that is manifestly inadmissible or unfounded may be rejected by its chair alone, without a hearing. You can also ask the consulate itself to reconsider (recours gracieux), but it is not worth waiting for its reply and losing the 30 days.
A Schengen C visa refused since 1 January 2023 is challenged not before the CRRV but before the sous-directeur des visas at the same address, also within 30 days.
The commission’s silence and the court in Nantes
If the CRRV has not answered within two months, the complaint is deemed rejected. In practice the commission is often silent and the case moves to court. From that point, or from an express rejection, you have two months to bring an annulment claim before the Nantes administrative court, the only court that hears these disputes.
- A lawyer is not compulsory. Before the administrative court representation is required only in money and contract disputes (service-public); a visa claim can be filed in person, though a lawyer specialising in immigration law noticeably improves the arguments.
- How to file. Online through Télérecours citoyens, in person or by post. The deadline is counted from registration at the court, not from sending. The claim includes the decision being challenged and proof that the CRRV complaint was filed.
- Urgency. Alongside the claim you can ask for a référé-suspension, a stay of the decision until the main hearing, if urgency is shown (service-public). It is not a separate route but an add-on to the main claim.
- What the court can do. When it annuls a refusal, the court may order the administration to issue the visa or to re-examine the application within a set time (CJA, Articles L911-1 and L911-2).
There is no statutory time limit for the court to decide. For a family planning a school year and a lease, that is the main reason to run a new application in parallel.
Reapplying: where and how
You can reapply as many times as you like; nothing forbids it. The application goes to the consulate or visa centre of the country where you legally reside; another country will accept the file only if you explain why you could not apply where you live (France-Visas). So “switching consulates” is an option only for those with a residence permit in another country. How applications work from Russia and from third countries is covered in the article on French visas for Russian nationals.
- The fee is paid again. The €99 for a visa D is not refunded on refusal or withdrawal (France-Visas); in Russia a €36 visa centre fee comes on top.
- Not a copy of the old file. The new application answers the ground of refusal: whatever was called weak is covered by documents and explained in a cover letter.
- Do not hide the earlier refusal. The consulate can see it, and unreliable information becomes a ground for refusal in itself.
What to strengthen in the file: talent, visiteur, family
Talent passport. In practice, since 2025 refusals have come even with DRIEETS or Ministry for the Economy approval, an incubator letter and proven funds: project approval is a condition of the card, but the visa is issued by the consulate, which checks the link to France and how genuine the plans are. What helps, according to several people’s experience: extra letters of support, a CV and diplomas, a clear role for the applicant in the project, a cover letter in French, and financial stability. The consulate may call or ask for documents, so be ready to talk about the project. The route’s conditions are in the articles on the talent passport for entrepreneurs, the French Tech Visa for founders and all talent passport categories.
Visiteur. Here a refusal most often turns on money and purpose. Funds are shown with a margin above the threshold, with statements over a long period and a document showing their origin: the sale of a flat, dividends, an inheritance. The undertaking not to work in France, housing for the whole period and insurance must have no gaps. Thresholds and the document list are in the article on the French visiteur visa.
Family. A decision is made on each application, and each is appealed separately: a spouse can be refused even when the main applicant is approved. Marriage and birth certificates need an apostille and a translation, and family members’ visas must match the main applicant’s ground. The family route for talent holders is in the article on the talent passport: family.

Earlier refusals and entry bans
An ordinary earlier refusal, Schengen or visa D, does not bar a new application, but the consulate takes it into account, especially if the ground is the same. An entry ban is different: an alert in the Schengen Information System is a ground for refusal in itself (Visa Code, Article 32), and it is lifted in the country that entered it, not by reapplying. If the refusal mentions the SIS or public order, find out where the alert came from first and only then apply.
Example: a family of four refused a talent passport visa
A founder with his wife and two children applied from Moscow for a «talent – porteur de projet» visa with project approval and €120,000 in the bank. On 10 March four refusals arrived with the same wording about a risk of misusing the visa.
| Step | Deadline | Cost |
|---|---|---|
| A CRRV complaint against each refusal | By 9 April | Postage; a lawyer is optional |
| CRRV silence = implicit rejection | 2 months after the complaint is received | — |
| Claim before the Nantes court | 2 months after the implicit rejection | No court fee; a lawyer is optional |
| A parallel new application with letters of support and a clear project role | When the file is ready, say in April | 4 × €99 + 4 × €36 = €540 |
€540 for a new application is a small part of what the family loses on a six-month pause: rent, the school year, a frozen project. So the sensible order is a complaint in the first days and a new application as soon as the weak points of the file are closed.
Common mistakes
- Counting the complaint deadline as two months from older articles and missing the 30 days.
- Writing to the CRRV in English or by email: the complaint goes by post, in French and signed.
- Waiting for the consulate to answer a request to reconsider and missing the CRRV deadline.
- Going to court without a CRRV complaint, or without proof that it was filed.
- Submitting the same file again without answering the ground of refusal.
- Hiding an earlier refusal on the new form.
- Demanding explanations from the consulate in a harsh tone: the arguments belong in the complaint, not in emails.
A visa D refusal is not the end, but the route is chosen in days, not months. If you have a refusal in hand, describe your situation and we will review the ground free of charge and say what makes more sense: a complaint, a new application or both. What comes after entry is covered in the article on life after entering France on a visa D.
What we do for the French talent passport
- We review the refusal: what the decision says and whether to appeal to the CRRV within 30 days or reapply with a stronger file.
- We check whether you qualify for the talent passport for business founders: a project, €30,000 to launch it, a master's degree or five years of experience.
- We prepare the business plan and the file for project approval by the French Ministry of the Economy.
- We handle the visa application through France-Visas and the French consulate in the country where you live — you do not need to travel to France to apply.
Frequently asked questions
Can a French visa refusal be appealed?
Yes. A visa D refusal is challenged before the CRRV commission in Nantes within 30 days of notification, by post, in French and signed. It is a compulsory step before court. If the commission rejects the complaint or stays silent for two months, you have two months to bring a claim before the Nantes administrative court.
Can I reapply after a refusal without waiting for the appeal?
Yes, nothing forbids it: a new application and a CRRV complaint can run at the same time. The €99 fee is paid again and the earlier one is not refunded. The new file must answer the ground of refusal, or the decision is likely to repeat itself.
How long does the CRRV take to answer?
Two months. If there is no answer by then, the complaint is deemed rejected, and from that point you have two months to go to the Nantes administrative court. In practice the commission often does not answer, so note the silence deadline in advance.
What if the consulate does not answer my visa application?
If there is no decision two months after the file was lodged, that is an implicit refusal. It is challenged before the CRRV within 30 days, just like a written refusal. The reasons for an implicit refusal can be requested within the appeal period and must be given within one month.
Do I need a lawyer to appeal a visa refusal?
No. The applicant, a family member or a lawyer can file the CRRV complaint, and representation is not compulsory before the administrative court in a visa dispute. The claim is filed online through Télérecours citoyens. An immigration lawyer helps with the arguments, but the law does not require one.
Why was my talent visa refused when DRIEETS approved the project?
Project approval is a condition of the card, but the visa is issued by the consulate, which checks the purpose of the trip, the risk of misuse and public order itself. In practice such refusals have happened since 2025; a new application with letters of support, a CV and a clear role in the project helps.
Does an earlier Schengen refusal affect a visa D?
An ordinary refusal does not bar a new application, but the consulate sees it and takes it into account. An entry ban is different: an SIS alert is a ground for refusal in itself, and it is lifted in the country that entered it. Earlier refusals must not be hidden on the form.
