Moving from Montenegro to Spain: with a residence permit, a Montenegrin passport or temporary protection

Moving from Montenegro to Spain works differently from moving from neighbouring EU countries. Montenegro is in neither the EU nor the Schengen area, so neither a Montenegrin residence permit nor the years spent in the country count for anything in Spain: you will have to obtain a basis from scratch. Most often this is the digital nomad visa for those who work remotely, and the non-working residence permit for those living on a pension or savings. Visa matters for residents of Montenegro are handled by the Spanish Embassy in Belgrade. Montenegrin citizens have it easier: they enter Spain without a visa and can apply for the nomad permit once there.

What to understand before reading on

A Montenegrin residence permit does not open Schengen. Russians and Belarusians with a Montenegrin residence permit still need a Schengen visa to travel to Spain.

Years in Montenegro do not carry over. Not for Spanish permanent residence, not for citizenship and not for a pension: there is no social security agreement between the countries.

The tax treaty is not yet in force. Its signing was approved in March 2026; until it enters into force, double taxation is relieved only by Spanish rules.

With a Montenegrin residence permit: a Spanish basis from scratch

A Montenegrin residence permit is a national permit of a country that is in neither the European Union nor the Schengen area. It gives no right to live in Spain and does not allow visa-free entry: Russians and Belarusians with a Montenegrin residence permit need a Schengen visa to travel to Spain. Ukrainian citizens with a biometric passport enter visa-free on their passport, not on the Montenegrin residence permit. Both lists are in the annexes to EU Regulation 2018/1806. Moving from other non-EU countries works the same way — for example, from Turkey to Spain.

Hence the main difference from moving from Bulgaria or another EU country: a resident of Montenegro has neither EU long-term resident status nor an EU Blue Card through which previous years could be counted. Montenegrin permanent residence after five years does not change anything either — the count for Spanish permanent residence starts with the first Spanish card. Remote work: the digital nomad visa

If you work for a company or clients outside Spain, the main route is the digital nomad residence permit. Income — from €2,849 a month, which is 200% of the Spanish minimum wage. For a second family member add €1,069, for each additional one €356.

There are two ways to apply. From Montenegro — a visa at the Spanish Embassy in Belgrade: it is also accredited to Montenegro, while in Podgorica Spain has only an honorary consul. The visa is issued for a year and exchanged in Spain for a three-year card. Or from within Spain: if you are there legally — on a Schengen visa, or visa-free as a citizen of Montenegro or Ukraine — the application goes to UGE, and the permit is issued straight away for three years.

A Montenegrin company through which you work is not an obstacle in itself. The conditions of the route are checked on substance: the company or client has existed for at least a year, your relationship with them has lasted at least three months, and no more than 20% of your income comes from Spanish clients.

Pension or savings: the non-working residence permit

Those who obtained a Montenegrin residence permit through property or live on a pension, rental income and savings should consider the non-working residence permit. Income — €2,400 a month for the applicant and another €600 for each family member, plus private health insurance with no excess. You may not work, either in Spain or remotely.

This permit cannot be obtained from within Spain: applications go only through a consulate, which for a resident of Montenegro means the embassy in Belgrade. The first card is issued for a year. The income must actually arrive in your account and be backed by bank statements, and a Montenegrin flat counts not in itself but through rental income or savings.

With a Montenegrin passport: no visa, but you still need a Spanish basis

A Montenegrin citizen enters Spain without a visa and can stay for up to 90 days in any 180-day period. This is a right to travel, not to live and work: to move, you need the same Spanish basis as other non-EU foreigners.

Visa-free entry gives one practical advantage: you can apply for the digital nomad visa from within Spain without booking an appointment at the embassy in Belgrade, and get a three-year permit straight away. The non-working residence permit cannot be obtained this way — only through a consulate. From the end of 2026, visa-free travel to Schengen will also require an ETIAS electronic authorisation; it does not apply to residents with a Spanish residence card.

For Ukrainians with temporary protection in Montenegro

Montenegro granted Ukrainians temporary protection by its own national decision. This is not European temporary protection, and it does not carry over to Spain: protection in Spain is applied for anew after arrival.

European temporary protection covers people displaced from Ukraine since 24 February 2022. The rules name no separate exclusion for those who first lived for several years in a third country, but there is no official clarification for this specific case either — the decision depends on your history, and it is worth checking before moving. For new applications since August 2026 there is an additional condition: proof of having fulfilled military service obligations to Ukraine or of exemption from them. The current period and procedure are published on the Ucrania Urgente portal.

Documents from Montenegro: apostille and criminal record certificate

Montenegro has been party to the Hague Apostille Convention since 2006, so Montenegrin documents for Spain are not legalised at a consulate but apostilled and translated into Spanish by a sworn translator. There is no exemption from the apostille, as there is between EU countries, either for citizens or for foreigners.

The criminal record certificate in Montenegro is issued by the Ministry of Justice. For the digital nomad visa it is provided from the country where you have lived for the last two years, and all countries of residence for five years before applying are checked.

A Montenegrin certificate is rarely the only one

Most Russian-speaking residents of Montenegro moved there in 2022 or later. This means the five-year period almost always includes the previous country of residence too — Russia, Belarus or Ukraine. Prepare both certificates at once, each with an apostille and a sworn translation: getting a Russian one through a consulate takes weeks.

Taxes when moving from Montenegro

There is no double taxation agreement yet

In Montenegro, income tax on salaries is progressive: 0% up to €700 a month, 9% up to €1,000 and 15% above that. The Spanish scale is considerably steeper. You become a Spanish tax resident if you spend more than 183 days a year in the country or your centre of economic interests is here — details in our article on Spanish tax residence.

There is not yet an agreement between Spain and Montenegro that would decide which country taxes income and who counts as resident in the year of the move. The text was initialled in January 2026, and the Spanish Council of Ministers approved its signing on 10 March 2026, but it has not entered into force. Until then, a Spanish resident credits tax paid in Montenegro under the general Spanish double taxation rule, and a treaty will not resolve a dispute about residence in the year of the move. It is worth documenting your departure date and centre of life from day one.

A Montenegrin company and property

  • Company. If you have moved but in practice manage a Montenegrin DOO from Spain, the Spanish tax authority may treat the company itself as Spanish resident — based on its place of effective management. The structure is worth reviewing before the move.
  • Rent in Montenegro. A Spanish tax resident declares worldwide income, including Montenegrin rent.
  • Asset reporting. Accounts, securities and property outside Spain worth more than €50,000 in any category are reported on Modelo 720.
  • Beckham regime. The flat 24% is available if you move for work and were not a Spanish tax resident for the previous five years. Whether it suits you is covered in our article on the Beckham Law in Spain.

Social security record, driving licence and car

Social security record. There is no social security agreement between Spain and Montenegro — Montenegro is not on the list of bilateral agreements of the Spanish Seguridad Social. Montenegrin insurance periods are not aggregated for a Spanish pension, and while living in Spain you pay contributions under Spanish rules.

Driving licence. Montenegro is not on the list of countries with which Spain exchanges licences. A Montenegrin licence, including one obtained in exchange for a Russian licence, is valid for six months from the moment you become a Spanish resident. After that only a Spanish licence is valid, which requires passing the exams.

Car. Montenegro is outside the EU customs territory, so bringing a car with Montenegrin plates counts as importing it from a third country, with customs clearance and subsequent registration in Spain.

Spanish citizenship: Montenegrin years do not count

Spanish citizenship by residence is granted after ten years of legal residence in Spain itself; years in Montenegro do not count towards this period. The reduced two years apply only to nationals of origin of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea and Portugal, as well as Sephardic Jews, under Article 22 of the Civil Code.

On naturalisation Spain requires you to declare that you renounce your previous citizenship, and Montenegro is not on the list of countries for which an exception is made. How this works in practice is covered in our article on dual citizenship in Spain.

Does a Montenegrin residence permit give the right to live in or travel to Spain?

No. Montenegro is in neither the EU nor Schengen, so a Montenegrin residence permit gives no right to live in Spain or to enter it without a visa. Russians and Belarusians need a Schengen visa, and to move — a Spanish basis.

Where do I apply for a Spanish visa if I live in Montenegro?
